Out of hours work applications

Demolition, construction work and deliveries of building material and equipment must not take place outside the hours of 7am to 5pm Monday to Friday and 8am to 12noon Saturday. No work and no deliveries are to take place on Sundays and public holidays.

Excavation using machinery must be limited to between 7am and 5pm Monday to Friday, with a respite break of 45 minutes between 12noon and 1pm. No excavation using machinery is to occur on Saturdays, Sundays or public holidays.

Where it is necessary for works to occur outside of these hours ie. placement of concrete for large floor areas on large residential/commercial developments or where building processes require the use of oversized trucks and/or cranes that are restricted by Roads and Maritime Services (RMS) from travelling during daylight hours to deliver, erect or remove machinery, tower cranes, pre-cast panels, beams, tanks or service equipment to or from the site, approval for such activities will be subject to the issue of an "outside of hours works permit" from Council as well as notification of the surrounding properties likely to be affected by the proposed works.

Out of hours work permits are for a temporary extension to approved consent conditions for works related to construction on a building site. 

Permits are issued for single events and a maximum of 2 consecutive days of out of hours works may be covered by one application. Approval will only be given for safety or public amenity reasons. Reasons related to occupant convenience or accelerated work programs will not be considered. 

To complete your application online you need to address the following

  • Whether partial or full road closures will be necessary for the activity to take place.
  • Local roads - will require an application be lodged with Council’s Traffic section. The application is to be lodged at least 3 weeks prior to the activity being scheduled.  

Temporary road closure application

Arterial roads - will require an application to the Roads and Maritime Service (RMS) for consideration. The application should be lodged with the RMS at least 6 weeks prior to the activity being scheduled.

There are two types of applications

Standard applications 

The application must be lodged 7 working days prior to the proposed activity. The types of works this application is proposed to be used for are scheduled works, which are program managed, such as concrete pours or delivery of site tower cranes and other extraordinary/large events.

The application will not be assessed until the relevant fees are paid in full and your application may be rejected if insufficient information is given. There is no refund of fees where an application is unsuccessful.

The permit holder will have a duty to inform all residents, businesses and institutes within 200 meters radius of the times the works will be conducted by way of a letter box drop 5 days prior to the works taking place.

Urgent applications  

These types of works application are applicable on days when site issues arise such as breakdown of concrete batching plant or other circumstances out of the control of the site management.

The application needs to be lodged as soon as possible prior to the necessary works. Urgency fees apply. 

The application will not be assessed until the relevant fees are paid in full and your application may be rejected if insufficient information is given. There can be no guarantee of service where an urgent application is lodged and the urgency fee will be refunded where the application is not assessed.

In the event the works are urgent due to mechanical failure, threat to health and safety or the like, all residents, institutes and businesses within a 200 metre radius of the development shall be informed of the works by way of personal service of the notification immediately following receipt of the permit for approval.

Failure to obtain a permit to work outside of approved hours will result in fines being issued.
