Feedback sought on dual occupancy minimum lot sizes

Community feedback is being sought on the proposed minimum lot sizes for dual occupancy developments across Ku-ring-gai.
Dual occupancy refers to two dwellings built on a single site, which may be attached or detached.
For dual occupancy to take place on a property, the site must meet the proposed minimum lot size.
In July last year the NSW Government permitted dual occupancy housing on all land zoned R2 (Low Density Residential) across NSW.
According to the government, R2 zoning permits ‘dual occupancies (2 separate homes on a single lot), such as duplexes’. Land which is bushfire prone, is a heritage item or is within a Transport Oriented Development area is excluded.
The NSW Government has provided 13 councils including Ku-ring-gai the opportunity to nominate minimum lot sizes for dual occupancy development to manage the impacts within established areas.
Council is now seeking feedback on two options for minimum lot sizes that:
- Meet the NSW Government’s requirements to deliver dual occupancies on 50% of Council’s R2 (Low Density Residential) land; and
- Seek to manage the impacts on Ku-ring-gai’s high quality garden character, including tall canopy trees and heritage conservation areas.
The proposed minimum lot sizes vary, depending on the development assessment pathway used and the location of the property.
The state government has set a 450 sq/m minimum lot size for development applications in Local Housing Areas (LHAs). LHAs are located around Ku-ring-gai’s train stations and St Ives Centre but exclude the Transport Oriented Development areas from Roseville to Gordon.
The public exhibition of the two options will take place between 22 January and 20 February.
Ku-ring-gai Mayor Christine Kay said that the Council would consider community feedback received during the public exhibition before making a decision, with the lot sizes to come into effect by June 2025.
“This is an important planning and housing supply issue for Ku-ring-gai and we encourage everyone to have their say,” Mayor Kay said.
The Mayor said an online forum was being organised to allow residents to find out more and ask questions, and a video of the forum will also be posted online for those unable to attend.
