Taking over an existing skin penetration beauty business
Your business will need to operate according to the approval, issued either by Council or a certifier, for the business you are taking over. If you are intending to carry out alterations, additions and/or change business hours, approval will be required either through a Development Application (DA) or a Complying Development Certificate (CDC).
It is recommended that you confirm the conditions of approval for the skin penetration beauty business prior to the purchase or signing of an agreement. Information can be obtained from the seller, agent or Council.

Other considerations:
- When you take over an existing skin penetration business, you must notify Council of your details via our online skin penetration business notification form
- If the business you are taking over has an existing waste and recycling collection service with Ku-ring-gai Council or another company, you should confirm that the service has been cancelled or transferred to your business. Note: Used sharps and clinical waste (e.g. single use equipment soiled with blood) are considered hazardous waste. Used sharps must be placed into an Australian Standards approved sharps bin. All hazardous waste must be collected and disposed through a licensed contractor. Used sharps must not be placed in general waste bins.

Setting up a new skin penetration beauty business in a commercial premises
If the shop you are intending to move into is not already a skin penetration beauty business then you will need approval for the change of use.
This can be obtained either through a development application (DA) or a complying development certificate (CDC).
You may need to apply for a DA if:
- The new use causes the contravention of any existing condition of the most recent development consent (other than a complying development certificate) that applies to the premises relating to hours of operation, noise, car parking, loading, vehicular movement, traffic generation, waste management or landscaping.
- The premises is listed as a heritage item.

The construction and fit-out of the skin penetration premises must comply with the Public Health Act 2010 and Public Health Regulation 2022.
